for the Webshop regarding Vienna Airport Services

§ 1 General

(1) The following General Terms and Conditions for the Webshop regarding Vienna Airport Services are an integral part of the contract and also apply for its conclusion. Terms and conditions of contractual partners or third parties shall not apply, even if no separate objection to their validity is raised by Flughafen Wien Aktiengesellschaft (abbreviated “FWAG”) in the individual case. These General Terms and Conditions are explicitly accepted by the contractual partner before the conclusion of contract.

 
(2) FWAG reserves the right to amend these General Terms and Conditions at any time.

§ 2 CONCLUSION OF CONTRACT

(1) The provision of the Webshop shall not be connected to any legally binding offer by FWAG as yet, but merely a non-binding request to the customer to submit an offer for the conclusion of a contract in accordance with these General Terms and Conditions (GTCs).

(2) By pressing the function key "Booking subject to", the customer shall submit a binding and irrevocable offer for the conclusion of a contract.

(3) This offer shall be accepted by the transmission of a reservation confirmation by FWAG, which shall be transmitted electronically immediately after submission of the offer. This effectively concluded the contract.

(4) With the conclusion of contract, FWAG undertakes to provide the service specified in the reservation confirmation to the contractual partner for the period (time) stated and defined in the reservation confirmation against payment of the fee listed in the reservation confirmation.

(5) Reservation by phone shall not be possible.

§ 3. SUBJECT OF THE CONTRACT

(1) The subject of the contract shall be exclusively and finally the provision of a service in accordance with the reservation confirmation in return for payment.
 
(2) The time of beginning of the service at the airport service counter shall be selected by the contractual partner when booking the relevant service.
 
(3) The selected scope of service shall begin immediately after arrival at the airport service counter in accordance with the reservation confirmation and be provided in consecutive individual services as listed in the following with regard to the respective service, which cannot be split up and the order of which cannot be changed:

§ 4 PAYMENT, FEE

(1) For bookings via the online form, the fee shall be payable immediately by credit card or by online banking. The amount can be identified on the credit card statement of the contractual partner with the payment reason " PAXServices Viennaairport ". The prices shown in the booking shall apply exclusively for the period booked.

(2) Escort services: No fee shall be payable for infants and children up to 2 years of age accompanied by an adult.
A discount of 50 percent shall be granted on the fee for the relevant service for children between 2 and 12 years of age accompanied by an adult. The full fee shall be payable for persons above the age of 12 years.


§ 5. CANCELLATION / WITHDRAWAL / FLIGHT CANCELLATION / NO-SHOW / CHANGE OF BOOKING

(1) Cancellation resp. Withdrawal

Cancellation of the booking or withdrawal from the contract is possible in writing, in each case stating the booking number, subject to the following conditions:
Withdrawal from the contract shall be possible free of charge within 14 days from the conclusion of contract, whereby the date of conclusion of the contract shall not be counted.
The costs of the cancellation shall be

  • 0% of the paid fee up to 14 days before the date of the flight departure;

  • 50% of the paid fee as of and including the 13th day up to and including the 6th day before the date of departure;

  • 100% of the paid fee as of and including the 5th day before the date of departure.

In the case of withdrawal or cancellation, the fee already paid shall be credited to the contractual partner again minus the possible costs in the same form as the payment was made.
 

(2) Flight Cancellation

In the event of a flight cancellation prior to provision of the service by FWAG, a rebooking of the service shall be possible.
In the event of a flight cancellation during provision of the service by FWAG, there shall be no refund or reduction of the fee for the relevant service booked.
In the case of flight cancellations during the service, provision of the service by FWAG shall end when the flight cancellation becomes known via the flight information system of Vienna Airport. Escort of the contractual partner to an airline service counter shall be possible.
 

(3) Delay / No-show by the Customer

If the contractual partner shows up late at the airport service counter in accordance with the booking confirmation, a contractually agreed provision of the booked service cannot be guaranteed. FWAG shall make every effort to provide the booked service despite these circumstances. In this case, a refund of the fee shall be ruled out in any case.

​(4) Additional Booking of Services

Additional booking of services in accordance with the Webshop catalogue shall be possible at any time at the prices published therein, however exclusively via the online booking form and not later than up to 24 hours before the beginning of the service. Cancellation of the original booking shall not be required.

§ 6 LIABILITY

(1) FWAG shall only be liable in the case of a breach of its contractual obligations in the event of wilful intent or gross negligence by its employees or agents. Otherwise liability shall be ruled out. FWAG shall not be in any way liable for the behaviour of third parties, nor for theft, damage etc., no matter whether these third parties were authorised or unauthorised to stay in the terminals or other areas of Vienna Airport. Under no circumstances shall FWAG be liable for losses of orders, losses of profits, non-incurred but expected savings, data losses or damages, third-party claims or any consequential damages.

(2) This limitation of liability to wilful intent and gross negligence shall also apply in the case of loss of the item taken over by FWAG.

(3) Any damages or possible claims must be reported to FWAG by the contractual partner in writing immediately, however not later than within 2 weeks after occurrence of the damaging event. If the contractual partner omits an immediate report, the contractual partner shall no longer be able to assert his claims for compensation.

(4) FWAG shall not be liable in the case of delayed performance due to force majeure such as, for instance, natural disasters of particular intensity, war, riots, strike, terrorism, unpredicted regulatory stipulations and other circumstances, which caused a delayed performance without the fault of FWAG.

§ 6 TERMINATION OF CONTRACT

The contract shall terminate with the end of provision of the contractual service.

§ 7 Venue

(1) The parties agree on the court of competence in rem for Vienna I as the exclusive court of jurisdiction for any disputes arising from or in connection with these GTCs resp. the contract concluded between the contractual parties.

(2) These GTCs resp. this contract shall be governed by Austrian law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

§ 8 FINAL PROVISIONS

(1) There are no verbal side agreements. Any side agreements must be made in writing.

(2) In the event of invalidity of individual provisions of these GTCs resp. the contract concluded with FWAG, the validity of the other regulations shall remain unprejudiced. The fully or partly invalid regulation shall be replaced by a regulation that covers the economic success of the invalid regulation and the parties’ intention as closely as possible; the same shall apply in the event of an omission.

(3) These GTCs shall be executed in German, which shall be binding for all matters in connection with them. Any version of these GTCs in a different language shall serve merely for better understanding and shall not have any legal effect. For clarification, it is noted that the German version of these GTCs has priority over any other language version of these GTCs.
