Flughafen Wien AG rejects allegations by Rakesh Sardana

 

Contract cancellations resulted solely from outstanding payments, failure to complete leased space and insufficient stocking of shops

 

With regard to today’s press release by Rakesh Sardana, Flughafen Wien AG would like to expressly state that the cancellation of the leases with companies in the Sardana Group was the result of outstanding payments, which had grown to millions of Euros over recent months, as well as the insufficient stocking of individual shops and the failure to complete his leased space in the new terminal Check-in 3.

 

This step was preceded by lengthy and, unfortunately, unsuccessful negotiations. Flughafen Wien also expressly rejects the allegations over alleged counterclaims. There are no such claims or factually justified grounds for such assertions.

 

Flughafen Wien AG clearly rejects the allegation made in the press release of a campaign against Mr. Sardana. These accusations refer to events that occurred nine years ago, which were previously made public and are currently the subject of investigations by the authorities. They are in no way related to the legal steps taken in connection with the lease agreements concluded by Artifacts, Saveria or Striberny. According to media reports, substantial payments are not only outstanding to Flughafen Wien: a report in the Wiener Zeitung on Saturday, 23 June 2012, indicated that Lower Austria’s health care provider (“Gebietskrankenkasse Niederösterreich”, GKK NÖ) has filed for the opening of bankruptcy proceedings because of outstanding receivables.

 

In order to enforce its claims, Flughafen Wien AG has taken various legal steps against the above-mentioned companies. Since the current legal proceedings have not brought the expected payments, Flughafen Wien AG has also filed an application with the provincial court in Korneuburg for the opening of bankruptcy proceedings against the above-mentioned companies. These steps are mandatory under Austrian stock corporation law.
